TENDER CONDITIONS OF SALE.

 

         

1.      The goods are sold  “as seen” and/or “as they lie”.

 

2.      The goods shall be open to inspection before any offer to purchase is made and the Purchaser shall be deemed to have inspected them and should the purchase be made without previous inspection the Purchaser shall do so at the Purchaser’s risk.

 

3.      Sales exclude the supply of Issue Vouchers ( MoD / RAF ).

 

4.      Sample – The sale is not a sale by sample, but if in any case a sample is supplied, it shall not imply a condition, warranty or representation as to the quality of the goods, or as to their freedom from any defect rendering them unmerchantable, or otherwise as respects the goods.

 

5.      There is no warranty given, expressed or implied as to the quality of the items or their suitability or fitness for purpose.

 

6.      Subject to prior sale.

 

7.      Subject to being unsold.

 

8.      Subject to Contract.

 

9.      Packaging only as available, seen in ( 1 / 2 ) above, ex works, Somerset.

 

10.  Goods will only be released for shipment upon full payment cleared into MASL Bank Account.

 

  1.  (i) Collection of goods including all costs is entirely the Purchaser’s responsibility.

 

(ii) Goods are to be collected within the period specified (see clause 11). Failure to collect within the specified time will incur a storage charge, charged at a rate of £250.00 per sq. ft. / week.

 

12.  Purchaser to ensure that all export / import documentation, licence regulations and approvals are complied with.

 

13.  The successful Tender will only be deemed to be accepted on receipt of full payment, (cleared into MASL Bank A/c ), payable within 7 days of Tender acceptance.
